So I didn't purchase gap coverage when I signed the contract. They told me that I had to get it the day I signed it. Also my insurance company doesnt offer Gap. So today I got a call from the dealer. They said that there was a mistake on the contract. Instead of .15 cents a mile I go over its should have been .20. I dont drive over 12000 miles a year so thats not the problem. I asked the dealer if I can now purchase Gap with this new contract and they said yes.
Question 1. Should I get the Gap for an extra 18 dollars a month on my smartbuy contract?
Question 2. I wanted to lease from day 1 but they told me that smartbuy is a better choice. Should I get them to change my whole contract to a smartlease? Does anyone know if the smartlease will be cheaper using the same numbers of the smartbuy contract? paid 35800, 3000 down. payments are 370 / month. (they also gave me 1250 rebate but I dont know if it would apply for a lease)
anyhelp would be appreciated.

36 month/ 12000 miles. When I called a few days ago to see if Gap was included, they specifically said "no".

Your contract said 15 cents a mile overage. That's the contract you and the dealer signed. They can't change it, unless you agree to it and sign an addendum or amendment, or an entire new contract. Someone else please correct me if I'm wrong...I don't lease vehicles, but last time I checked, what's on a signed contract is generally how it's going to be? A lawyer would also help...I'd make 'em stick to the original. It's their f-up, not yours.

Word. How can they make or force you to do another contract because they messed up? Was there ever a mile overage discussed or written on any buying order?

It says on my contract .15. Im thinking that I can try and make a deal. I sign the new contract and get GAP included, keeping my monthly payment of 370.

That is exactly right. When I bought my GTO they put the 12,000 mile a year interest rate for Smartbuy on my contract instead of the 15,000 mile a year. They tried to be sly and get me to sign a new contract, but when they met me near my home I noticed it would have raised my payment $19. I told them I alrady went $15 over my goal..and their response was "What's $19 more a month?" Well, just so happens my bro-in-law is a very well established salesman in WNY...and he told me ahead of time to do nothing if anyting changes. ;) Since she also included the $19 condescending remark, and called her dealership huffing I wouldnt sign, I told her tough **** to her face and that it was their mistake...now they can eat it.
Contracts are there to protect the seller, BUT ALSO THE BUYER!! I would not sign a new contract at all. Also, I would go to A NEW insurance company! I have never heard of a solid insurance company NOT offering gap insurance. What, they don't want more money????

went to the dealer. They gave me Gap coverage for 8 dollars a month instead of the 18. I am pretty happy about it.
